1. Acceptance of Terms

By accessing or using Replify ("Service"), operated by Replify ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

Replify is an Instagram automation platform that allows users to set up automated replies to comments and direct messages on their Instagram accounts. Our Service includes:

• Automated DM replies triggered by comments or keywords
• Story mention triggers and welcome DMs
• Analytics and engagement tracking
• Multiple automation management

3. Account Registration

To use Replify, you must connect your Facebook and Instagram accounts. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activity that occurs under your account

4. Instagram Platform Compliance

Replify operates using Meta's official Instagram Graph API. You agree to:

• Comply with Instagram's Terms of Use and Community Guidelines
• Not use the Service for spam or unsolicited messaging
• Not use the Service to harass, threaten, or harm other users
• Not violate any applicable laws or regulations
• Use the Service only for legitimate business or personal purposes

5. Subscription Plans and Payments

Replify offers the following plans:

• Free Plan: 1 automation, 500 DMs/month at no cost
• Starter Pack: One-time payment of ₹99 for 3 automations and 3,000 DMs lifetime
• Creator Pack: One-time payment of ₹149 for 5 automations and 6,000 DMs lifetime
• Influencer Pack: One-time payment of ₹299 for 10 automations and 15,000 DMs lifetime
• Celebrity Plan: ₹599/month for unlimited automations and DMs

All payments are processed securely through Razorpay. One-time pack purchases are non-refundable once the plan is activated. Monthly Celebrity plan subscriptions may be cancelled at any time, with access continuing until the end of the current billing period.

6. Refund Policy

We offer refunds in the following circumstances:

• Technical issues on our end that prevent the Service from functioning
• Duplicate charges due to payment processing errors
• Requests made within 24 hours of purchase if the Service has not been used

7. DM Limits and Fair Use

Each plan includes a specified DM limit. For one-time packs, DM limits are lifetime totals. For the Celebrity plan, limits reset monthly. We reserve the right to throttle or suspend accounts that show patterns of abuse or spam.

8. Prohibited Uses

You may not use Replify to:

• Send spam, unsolicited, or bulk messages
• Impersonate any person or entity
• Distribute malware or harmful content
• Violate any third party's privacy or intellectual property rights
• Engage in any activity that could damage or overburden our infrastructure
• Attempt to reverse engineer or hack our platform

9. Intellectual Property

All content, features, and functionality of Replify, including but not limited to text, graphics, logos, and software, are owned by Replify and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We are not responsible for any actions taken by Instagram or Meta that may affect the functionality of our Service.

12. Limitation of Liability

To the maximum extent permitted by law, Replify shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total liability shall not exceed the amount paid by you in the 3 months preceding the claim.

13. Service Availability

We strive to maintain 99% uptime but do not guarantee uninterrupted service. We may suspend or terminate the Service at any time for maintenance, security reasons, or if required by Meta's API policies. We will provide reasonable notice where possible.

14. Account Termination

We reserve the right to suspend or terminate your account at our sole discretion if you violate these Terms. You may delete your account at any time by contacting us at support@replify.in.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Tamil Nadu, India.
